Welcome to Peaceful Pail. This website (peacefulpail.com) is owned and operated by Peaceful Pail. Throughout the site, the terms “we”, “us” and “our” refer to Peaceful Pail. By visiting our site and/or purchasing products from us, you engage in our “Service” and agree to be bound by the following terms and conditions.
Section 1 - General Conditions & Age Grading
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. Our products are designed and intended for childhood play for ages 3 and up. Children should always be supervised by an adult during indoor and outdoor play.
Section 2 - Product Information, Care, & Expectations
We make every effort to display the colors and images of our products as accurately as possible. Because our products are crafted using natural, earth-conscious, bio-sourced materials, slight structural variations, textures, or minor cosmetic variances are a natural part of the material characteristic.
Customers are responsible for following the provided Care & Safety Guidelines. Peaceful Pail is not liable for material warping, degradation, or damage resulting from exposing the products to extreme temperatures, prolonged direct sunlight outside of normal play, or high-load bacterial environments.
Section 3 - Intellectual Property & Proprietary Designs
All content included on this site, including but not limited to text, graphics, logos, product shapes, nesting mechanics, and manufacturing designs, is the exclusive property of Peaceful Pail and is protected by international copyright, trademark, and intellectual property laws. You agree not to reproduce, duplicate, copy, or exploit any portion of our designs or products without express written permission from us.
Section 4 - Accuracy of Billing & Account Information
We reserve the right to refuse any order you place with us. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store, including your email address and credit card numbers, so that we can complete your transactions and contact you as needed.
Section 5 - Changes to Terms of Service
You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check our website periodically for changes.
Section 6 — Product Safety & Compliance
Peaceful Pail products are designed and manufactured in the United States in accordance with the U.S. Consumer Product Safety Improvement Act (CPSIA) and applicable federal children's product safety standards. Our products are intended for children ages 3 and up.
WARNING: CHOKING HAZARD. Products may contain small parts and are not intended for children under 3 years of age. Adult supervision is required during all play.
Section 7 — Limited Warranty & Disclaimer
Peaceful Pail warrants its products against defects in materials and workmanship under normal use for a period of thirty (30) days from the date of delivery. This warranty does not cover damage caused by misuse, accident, exposure to extreme temperatures, prolonged direct sunlight outside of normal play, high-load bacterial environments, or natural variation inherent to bio-sourced materials.
EXCEPT FOR THE LIMITED WARRANTY ABOVE, PEACEFUL PAIL DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow the exclusion of implied warranties, so this exclusion may not apply to you.
Section 8 — Limitation of Liability
To the maximum extent permitted by law, Peaceful Pail's total liability for any claim arising out of or related to these Terms or your purchase or use of our products shall not exceed the purchase price you paid for the specific product giving rise to the claim. In no event shall Peaceful Pail be liable for indirect, incidental, consequential, special, or punitive damages. Some states do not allow the limitation of certain damages, so this limitation may not apply to you.
Section 9 — Governing Law & Jurisdiction
These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law provisions. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Hays County, Texas.
